Terms and Conditions for Engagement, Purchase and Service - Prizma Optic

 

1. General

These terms and conditions govern the relationship between "Prizma Optic" (hereinafter: "the Business") and its customers. Placing an order, paying a deposit, or receiving any service constitutes binding agreement to these terms. Since these terms are sent for the customer's review (via a link in a message) after the order is placed, the customer has the right to notify the Business of any disagreement with these terms within 24 hours of receipt, provided that production of the product has not yet commenced. In the absence of such notification, it shall be considered final and conclusive agreement to these terms. Images in the Business's publications are for illustration purposes only.

 

2. Eye Examinations and Consultation Services

Eye examinations are performed by a certified optometrist. An eye exam is provided as a complimentary benefit with the purchase of a complete pair of glasses (frame + lenses). If no purchase is made, the customer will be charged an examination fee of ₪200. Examination results will be released to the customer only after payment has been settled. In the case of an order based on an external prescription (not performed by the Business), the Business is not responsible for any non-conformity resulting from errors in said prescription.

 

3. Cancellation and Return Policy - Custom-Made Products

Lenses and custom-made products: In accordance with Consumer Protection Regulations, the right of cancellation does not apply to goods manufactured specifically for the consumer. Therefore, it is not possible to cancel a transaction or receive a refund for prescription lenses, multifocal lenses, optical sunglasses, or contact lenses that have been opened or ordered according to a personal prescription.

Sunglasses (off-the-shelf): Transaction cancellation is permitted within 48 hours of purchase (business days), provided the product is returned in its original packaging, has not been used, and no physical adjustments have been made (such as temple alignment).

Cancellation fee: For any lawful transaction cancellation, the customer will be charged a cancellation fee of 5% of the transaction value or ₪100 (whichever is lower).

 

4. "Package Breakdown" Mechanism

In the event of a promotional package purchase (e.g., "complimentary frame with lens purchase") and the lawful cancellation of part of the transaction:

  • The discount provided as part of the package will be voided.
  • The product remaining with the customer will be charged according to full catalog price (importer/consumer price list) as it appears in the Business's systems on the date of purchase.

 

5. Ceiling for Benefits and Gifts

Any benefit provided as a "gift" (such as a complimentary frame of choice) is limited to a monetary ceiling as defined at the time of the order. Any selection of a product exceeding this ceiling will require the customer to pay the difference.

 

6. Warranty and Service for Frames and Lenses

Manufacturer's warranty: Provided for 12 months for manufacturing defects only. It does not cover breakage, scratches, loss, or damage resulting from unreasonable use.

Customer's own frame: The Business is not responsible for any damage or breakage caused to a frame belonging to the customer ("old frame") during lens fitting, repair, or handling. Work performed on a customer's frame is at their sole risk and responsibility.

 

7. Extended Adaptation Policy - Multifocal Lenses

The Business grants an extended 90-day "adaptation warranty" for multifocal lenses. This benefit is provided "ex gratia" (beyond the requirements of the law, unlike standard custom-made products). In the event of non-adaptation (following an examination and consultation with the Business's optometrist), the customer will have two options:

  • Lens replacement: Replacing the multifocal lenses with a pair of single-vision lenses (or two pairs: distance and near). The customer will be credited for the price difference between the multifocal price paid and the price of the new lenses.
  • Monetary refund for lenses only: The customer shall be entitled to return the lenses and receive a full monetary refund for them.
  • Clarification regarding the frame: The frame into which the lenses were fitted is considered a used ("second-hand") product that has undergone use and adjustment; therefore, it cannot be returned or credited.
  • If the original transaction was performed as part of a "package" or discount that included the frame, the refund amount will be calculated minus the full catalog price of the frame remaining with the customer.

 

8. Supply and Collection of Products

Supply times provided to the customer are estimated and may change based on stock availability at the manufacturer's laboratories. The customer must collect the product within 90 days from the date of notification of its readiness. After this period, the Business shall not be responsible for storing the product.

 

9. Privacy, CRM and Direct Marketing

The customer authorizes the Business to store personal information, purchase data, and prescriptions in its databases. The customer agrees to receive marketing content (SMS, WhatsApp, email). Removal can be requested by clicking the "unsubscribe" link or sending a "remove" message. The Business may use third-party technologies (pixels/cookies) for advertising customization (retargeting).

 

10. Payments and Jurisdiction

Payment shall be made by credit card or cash. Checks will not be accepted. Exclusive jurisdiction for any matter arising from this engagement shall lie with the competent court in the district where the Business operates.
